SEAMAN; CHARTER ONE BANK, N.A.; OCCUPANTS RESIDING AT: 162 GROVE STREET POULTNEY, VT 05764 Defendants NOTICE OF SALE By virtue and in execution of the Power of Sale contained in a certain mortgage given by Eugene G. Seaman to Chater One Bank, N.A. , its successors and/or assigns, dated February 13, 2003 and recorded in Book 115 at Page 484-493 of the Town of Poultney Land Records, for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction at 11:00 a.m. on March 8, 2017 at 162 Grove Street, Poultney, VT 05764 all and singular the premises described in said mortgage, To Wit: Being the same lands and premises conveyed to Eugene G. Seaman by deed of Michael P. Griffin and Mary Lou Griffin dated November 24, 1999 and recorded in the Town of Poultney Land Records in Book 103 at Pages 319-20 on November 30, 1999. Being all and the same lands and premises conveyed to Michael P. Griffin and Mary Lou Griffin by deed of Richard D. Parrott and Barbara Parrott dated October 24, 1988 and recorded in the Town of Poultney Land Records in Book 79 at Page 377 and more particularly described as follows: Being all and the same lands and premises conveyed to Barbara Cahee (now Barbara Cahee Parrott) and Richard D. Parott by deed of Richard F. Munch by deed dated November 25, 1985 and recorded in the land records of the Town of Poultney in book 74 at pages 12-13. The premises are more particularly described therein as follows: “Being the same lands and premises conveyed to Richard F. Munch by warranty deed from James Mainolfi and Audrey J. Mainolfi, husband and wife, dated May 19, 1981 and recorded in book 66 at page 34 of the Poultney Town Land Records. Being all and the same lands and premises conveyed to James Mainolfi and Audrey J. Mainolfi, husband and wife, by warranty deed from the Proctor Trust Company, Trustee of the Walter L. Atkins Trusts for the benefit of Helen Atkins, Brent Atkins and Neil Atkins, which warranty deed is dated August 4, 1976 and recorded in volume 62 at page 77 of the Poultney Land Records and therein described as follows: Being the same lands and premises conveyed to Walter Atkins and Mary Atkins, husband and wife, by deed of Gaylord Baker, c.t. a. Administrator of Sarah Gluck Weltman Estate dated March 5, 1937 and recorded in book 43 at page 348-349 of the Poultney Land Records and being more particularly described therein as follows: Beginning in the west line of Grove Street in the Village of Poultney at a point 67 feet south from southeast corner of the house lot lately occupied by Belle Oakman: thence northerly in the west line of said Grove Street 67 feet to the southeast corner of said Belle Oakman house lot thence westerly in the south line of said Oakman house lot to the east line of lands of Lucia A. Clarks estate: thence southerly in the east line of said Lucia A. Clarks land 52 feet to a post and thence easterly in a straight line to the place of beginning. This conveyance is made on condition that no buildings shall be erected on said premises except a dwelling house or dwelling houses and other buildings to be used in connection therewith. But excepting and reserving from the above described premises so much of the same as lies south of a line running westerly across said premises at a distance of three feet north of the north side of the dwelling house of Richard R. Thomas, and three feet north of the north side of the barn of Richard R. Thomas. Being the same premises conveyed to Sarah Weltham by Joseph L. Green by deed dated the 27th day of July, A.D. 1910 and recorded in the Poultney Land Records in book 33 Page 464 to which deed and record thereof a more complete description may be had, and being all of the real estate whereof the said Sarah Gluck Weltham died seized and possessed in the Town of Poultney. Reference is made to a Decree of Partial Distribution in the Estate of Walter L. Atkins recorded in book 62 at pages 47-48 of the Poultney Land Records and dated July 6, 1976. The description of the property contained in the mortgage shall control in the event of a typographical error in this publication. The public sale may be adjourned one or more times for a total time not exceeding 30 days, without further court order, and without publication or service of a new notice of sale, by announcement of the new sale date to those present at each adjournment or by posting notice of the adjournment in a conspicuous place at the location of the sale. Terms of Sale: $10,000.00 to be paid in cash or by certified check by the purchaser at the time of sale, with the balance due at closing. The sale is subject to all liens, encumbrances, unpaid taxes, tax titles, municipal liens, if any, which take precedence over the said mortgage above described. The Mortgagor is entitled to redeem the premises at any time prior to the sale by paying the full amount due under the mortgage, including the costs and expenses of the sale.
